Residential Property


We want to be completely open and transparent in how we calculate our legal charges and disbursements.     We set out below our conveyancing fees and disbursements for dealing with a residential property.   Where possible we charge a fixed fee so you know the amount you will pay at the outset.

Where VAT is stated to be payable, VAT will be charged at the standard rate (currently 20%).

Subject to the Assumptions * below we charge the following fixed fees for the conveyancing work in the sale and purchase of freehold residential properties and the following fees in the mortgaging and remortgaging of freehold residential properties.

  1. Sale and Purchase of a Freehold Residential Property

Purchase of a Freehold Residential Property - Fixed Fees

Our fees.

Our fee covers all the legal work required to complete the purchase of your property including reporting the purchase to H M Revenue & Customs if required and registering the purchase of your property at the Land Registry.   Our fixed fee in your purchase will be as follows.

Purchase price up to £150,000 –

Stamp Duty Land Tax

Stamp Duty Land Tax may be payable depending on the purchase price and subject to any available exemptions and reliefs.

Disbursements

The disbursements in your purchase are likely to be as follows.

Pre-contract search fees depending on the searches that are required - typically £350.00 - £400.00 including VAT.

Bank fee for CHAPS transfer of funds - £23.00 plus VAT of £4.60 per CHAPS payment.

Land Registry search fees - £3.00 per title.

Land Charges Registry search fees - £2.00 per person.

Land Registry fee for registering the purchase - typically £20.00 - £270.00.

VAT is not payable on Land Registry fees and Land Charges Registry.

Sale of a Freehold Residential Property - Fixed Fees

Our fee covers all the legal work required to complete the sale of your property.    Our fixed fee in your sale will be as follows.

Disbursements

The disbursements in your sale are likely to be as follows.

Land Registry fees for copy documents typically - £6.00 - £15.00.  VAT is not payable on Land Registry fees.

Bank fee for CHAPS transfer of funds - £23.00 plus VAT of £4.60 per CHAPS payment.

*   Assumptions

Our fixed fees estimate in the purchase and sale of a freehold residential property assume this is a standard transaction that proceeds smoothly to completion with no complications or complexities.   Additional fees plus VAT will be payable if there are complications or complexities or if any of the following apply which will result in us having to undertake additional work on your behalf:

  • the property is a new build or less than 10 years old;
  • the property is a historic property;
  • the property is being sold or purchased at auction;
  • the property is subject to a service charge or annual maintenance charge towards privately maintained facilities such as private roads, open space and recreation areas;
  • the property is shared ownership;
  • the property has solar panels;
  • contract races;
  • there is a lock-out or exclusivity agreement;
  • the title to the property is unregistered;
  • there is a declaration of trust;
  • there is a gifted deposit;
  • there are tax implications or consideration of tax planning strategies;
  • advice on planning; and
  • the property is part of a farm.

We will notify you of any additional fees as soon as we become aware of any of the above.

Sale and Purchase of a Leasehold Residential Property - Fixed Fees

There is a lot more work involved in the sale and purchase of a leasehold residential property including liaising with the Landlord and any Management Company and Managing Agents for information regarding service charge.  Our fee in the sale or purchase of a residential leasehold property will be the same as the corresponding fee for the sale or purchase of a freehold property plus an additional £250.00 plus VAT of £50.00 to cover the additional work.

  1. Mortgages and Remortgages – Fixed Fees

Subject to those Assumptions * above which apply to a mortgage or remortgage, our fee covers all the legal work required to complete the mortgage of your property including reporting to the lender and registering the new mortgage of your property at the Land Registry.

A mortgage is where you are taking out a new mortgage over your property and the property is not subject to an existing mortgage.   A remortgage is where the property is subject to an existing mortgage and you are paying off any existing mortgages and having a new mortgage.

Our fixed fee in your mortgage and remortgage will be as follows.

Remortgage –

Our fee is the same as in a mortgage based on the amount for your new mortgage plus an additional fee of £100.00 plus VAT of £20.00 for each mortgage that is to be repaid.

Disbursements

The disbursements in your mortgage or remortgage are likely to be as follows.

Pre-completion search fees depending on the searches that are required - typically £350 - £400 including VAT.   If the lender is prepared to proceed on the basis of search insurance the search insurance including Insurance Premium Tax will typically be £100 - £300.

Bank fee for CHAPS transfer of funds - £23 plus VAT of £4.60 per CHAPS payment.

Land Registry search fees - £3.00 per title.

Land Charges Registry search fees - £2.00 per person.

Land Registry fee for registering the purchase - typically £20 - £270.

VAT is not payable on Land Registry and Land Charges Registry fees.

Mortgages and Remortgages of a Leasehold Residential Property - Fixed Fees

There is also a lot more work involved in the mortgage and remortgage of a leasehold residential property including liaising with the Landlord and any Management Company and Managing Agents for information regarding service charge.  Our fee in the Mortgage or Re-mortgage of a residential leasehold property will be the same as the corresponding fee for the Mortgage or Remortgage of a freehold property plus an additional £250.00 plus VAT of £50.00 to cover the additional work.

  1. Other Residential Property Transactions

Our fees for other property transactions are calculated by reference to our standard hourly rate of £275.00 plus VAT of £55.00.   In addition, we also charge any disbursements.     We are happy to provide an estimate at the start of the transaction.
